Here’s a great opportunity to get some tips on how to conduct an effective internal I-9 audit.

One thing Amy always mentions on this topic: she almost universally finds clients turn up many non-compliant I-9s when they conduct an audit. Half or more of I-9s have problems for a typical employer that handles I-9s with pen and paper.

Still think you don’t need to conduct an I-9 audit?

Think again. Failure to review your existing I-9s for errors and violations can prevent you from asserting your good faith as a mitigating factor in the event you are assessed a fine. A California event producer was hit with over $800,000 in fines by ICE for, among other technical violations, non-compliant methods for handing contingent workers based on a procedure developed by its union. The company noted on its appeal it had no history of violations, copied and retained work authorization docs, and worked promptly to correct technical and procedural violations. The fine was reduced to about $600,000 , but the hearing officer declined to reduce the fine further, noting that the company could not assert that it had acted in good faith when it did not act to correct violations until after it had received the Notice of Inspection from ICE.
