E-verify mandate to come?  Survey says…

U.S. Citizenship and Immigration Services (USCIS) took a fairly big step toward determining the fate of the much rumored E-verify mandate.  While the details and any timeframe for a potential E-verify mandate are still to be determined, USCIS is looking to hear from E-verify employers.  On February 11, 2015, USCIS published a notice to the Federal Register (80 FR 7625) seeking approval for its 2015 Survey of E-verify Employers “to obtain data from E-verify employers in anticipation of the enactment of mandatory state and/or national eligibility verification programs for all or a substantial number of employers.”

What does this mean for you?  For starters, if the survey is approved it means E-verify employers could soon have an opportunity to provide important feedback on the E-verify program.  Meanwhile, speculation of an E-verify mandate will continue, but one thing is clear:  USCIS is taking steps to do its homework and prepare – and you may want to begin doing so as well.

Many higher education institutions are only using E-verify with those employees who are working on a federal grant.  With that said, it may be time to review our policies and consider whether to start E-verifying all employees so that you are better prepared for the mandate.

So will there be an E-verify mandate in the near future?  The survey says… we are at least getting closer to that answer.
