Form I-9 Expiration Update
U.S. Citizenship and Immigration Services (USCIS) has stated that employers should continue to use the current version of the Form I-9 until further notice, even after the expiration date of Aug. 31.
Updated information about the new Form I-9 will be made available on I-9 Central as it becomes available.
Form I-9 Expiration Date
The current Form I-9 expiration date is August 31, 2019. This does not mean that employers should not worry about completing I-9s for new employees after August. In fact, it’s more critical than ever that employers are gathering I-9s for all new employees since I-9 worksite enforcement is on the rise.
Every time the government releases a new Form I-9, it sets an expiration date. This allows the government to make periodic updates to the form. We expect that U.S. Citizenship and Immigration Services (USCIS) will release a new version of the form before the expiration date on August 31. Once it releases the new form, employers should begin using it. Employers should not use the expired form if a new version is available.

What Happens if You Use an Expired Version of Form I-9?
Although we do not expect major changes for the new version of the Form I-9, employers must still switch to the new form. If employers use an expired form when a new version is available, the government could consider it a violation. If your organization is audited, the cost of not switching to the new version could add up quickly with steeper penalties for errors on Form I-9 in 2019.
